These Terms and Conditions govern the access to and use of the digital real estate crowdfunding platform operated by Enfoquegloballatam S.A.S., a company incorporated under the laws of the Republic of Colombia, with NIT 901.456.789-3, domiciled at Carrera 11A #93-52, Office 401, Bogotá D.C., Colombia.
1. Acceptance of Terms
By accessing and using the enfoquegloballatam.com platform, you fully accept these Terms and Conditions. If you do not agree with any of the terms established herein, we ask that you refrain from using the platform.
2. Nature of the Service
Enfoquegloballatam operates a technological platform that facilitates the connection between investors and real estate projects in Colombia. The platform provides information about available projects and allows users to express their interest in participating. The Company does not act as a financial intermediary, public resource collector, or investment advisor.
3. Investment Risks
All investment in real estate projects carries inherent risks that include, but are not limited to: partial or total loss of invested capital; delays in project execution; fluctuations in the Colombian real estate market; regulatory risks and normative changes; illiquidity of the investment during the project period. The user acknowledges and accepts these risks when using the platform. Past returns do not guarantee future performance.
4. User Requirements
To use the platform, the user must: be over 18 years of age; have legal capacity to enter into contracts in Colombia; provide truthful and updated information; accept these Terms and Conditions and the Privacy Policy.
5. Intellectual Property
All content on the platform, including texts, graphics, logos, images, software, and data compilations, are the property of Enfoquegloballatam S.A.S. or its licensors and are protected by Colombian and international intellectual property laws. Reproduction, distribution, or modification of any content without express authorization is prohibited.
6. Limitation of Liability
Enfoquegloballatam does not guarantee the profitability of projects published on the platform. The Company shall not be liable for: investment decisions made by users; losses derived from investments made; temporary service interruptions due to maintenance or force majeure; indirect, incidental, or consequential damages derived from the use of the platform.
7. Applicable Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Colombia. Any dispute arising from their interpretation or compliance shall be submitted to the jurisdiction of the competent courts and tribunals of Bogotá D.C., Colombia, unless current regulations establish a different jurisdiction.
8. Modifications
Enfoquegloballatam reserves the right to modify these Terms and Conditions at any time. Modifications will take effect from their publication on the platform. Continued use of the platform after the publication of modifications constitutes acceptance of the new terms.
